AMS Key Patrol™ Terms and Conditions – CCPA & GDPR Compliance
1. COLLECTION OF INFORMATION RIGHTS
AMS Key Patrol™ and its affiliates (“AMS Key Patrol AirKey™ Auto” or “Company”) provide technology, communication, and marketing services to automotive dealership partners through a wireless/mobile IoT gateway device that integrates cellular communications, telematics/sensor technologies, emails, text messages, and related services (collectively, “Services”).
During use of the Services, Key Patrol™ may collect Vehicle Information, including your vehicle’s location, travel direction, mileage, and other operational data. This information is collected only to provide and improve Services. Vehicle Information is never sold to third parties.
By accessing the Services, you consent to the collection, logging, storage, and sharing of Vehicle Information with:

Participating dealerships for service and operational purposes.

Trusted service providers and partners assisting with Service delivery.

Legal authorities, if required by law or to protect against fraud or security risks.
2. OPT-OUT & COMMUNICATION RIGHTS
You may opt out of marketing communications from Key Patrol™ at any time:

Use the “unsubscribe” link in emails or texts.

Update your account preferences in the Key Patrol™ application.
Vehicle Information transmission occurs over wireless networks; Key Patrol™ is not liable for privacy risks inherent in network communication.
3. RESTRICTION & TERMINATION RIGHTS
Key Patrol™ may restrict, suspend, or terminate your account and access to Services if you violate these Terms or are found ineligible. Prepaid Services are non-refundable once activated. Key Patrol™ may also restrict Services due to insolvency, force majeure, or events beyond control.
4. TERMS AMENDMENT
Key Patrol™ reserves the right to modify these Terms at any time. Updates take effect when posted, and continued use constitutes acceptance.
5. PROPERTY AND SYSTEMS
Key Patrol™ maintains sole ownership and control over all Services, Vehicle Information, trademarks, and intellectual property. Unauthorized use of trademarks, service marks, or copyrighted materials is prohibited.
6. COMPLIANCE & SAFETY
Users must comply with all applicable laws and operate vehicles safely. Do not use Services or Vehicle Information in a manner that could cause harm, damage networks, or violate rights of others.
7. LIMITED WARRANTY & LIABILITY
Key Patrol™ does not guarantee continuous availability or accuracy of Services or Vehicle Information. All warranties, express or implied (including merchantability, fitness for purpose, or non-infringement) are disclaimed.
Key Patrol™ is not liable for damages arising from errors, delays, or interruptions in Services. Liability is limited to actual damages only.
8. INDEMNIFICATION
You agree to defend and hold Key Patrol™ harmless from liabilities, losses, or claims arising from your use of Services, Vehicle Information, or breaches of these Terms.
9. DATA RIGHTS – CALIFORNIA RESIDENTS (CCPA)
California residents have the following rights:

Right to Know: Request categories of Vehicle Information collected and shared.

Right to Access: Request a copy of Vehicle Information collected.

Right to Delete: Request deletion of your Vehicle Information, subject to legal obligations.

Right to Opt-Out of Sale: Vehicle Information is not sold.

Non-Discrimination: Exercising your rights will not result in service discrimination.

10. DATA RIGHTS – EU RESIDENTS (GDPR)
EU residents have the following rights:

Access, Rectification, Erasure, Restriction, Object, and Portability of Vehicle Information.

Withdraw Consent: Where processing is based on consent.

Complaint: Lodge complaints with local Data Protection Authorities.

11. RETENTION
Vehicle Information is retained only as necessary for providing Services, legal compliance, or security purposes.
12. DISPUTE RESOLUTION
Disputes regarding Services or Vehicle Information shall first be attempted to be resolved through negotiation, then mediation, and if unresolved, binding arbitration under the American Arbitration Association rules. All claims are individual, not class actions.
13. GOVERNING LAW & VENUE
These Terms are governed by the laws of Texas or U.S. federal law as applicable. Exclusive venue: Tarrant County, Texas, or U.S. District Court, Northern District of Texas.
14. RETURN & EXCHANGE POLICY
All product purchases are final. Defective products may be replaced within 1 year with Key Patrol™ covering S&H, following RMA issuance. Exchanges may occur within 30 days at the customer’s S&H expense.
